12. OUR RESPONSIBILITY

2. RIGHT OF RETENTION
The delivered products remain the property of Designyours.fr until they are handed over to the carrier.

LEGAL RIGHT OF WITHDRAWAL
Unless one of the exceptions listed below is applicable, you may withdraw from your order without giving any reason within 14 days running from the date on which you, or a third party designated by you (other than the carrier), has taken physical possession of the goods purchased (or of the last good, batch or part if the contract relates to the delivery of
• delivery of products that have been made to your specifications or clearly personalized;
• the supply of products liable to deteriorate or expire rapidly;
• the provision of services fully executed by Designyours.fr for which you agreed at the time of placing your order that we begin their execution, and waived your right of withdrawal;
• the supply of newspapers, periodicals or magazines with the exception of subscription contracts to these publications; And
• the supply of alcoholic beverages whose value agreed at the conclusion of the contract depends on fluctuations in the market beyond our control.
OUR 30-DAY RETURNS POLICY
Without prejudice to the rights recognized by law, Designyours.fr offers the following return policy:
All products from Designyours.fr sites can be returned within 30 days of receipt of the products by Designyours.fr if the products are complete and in new and undamaged condition. With regard to data carriers wrapped in plastic or sealed (for example, CDs, audio cassettes, VHS videos, DVDs, PC games, video games and software, items from the Hygiene, Beauty and Animal Health shop), we do not only take them back if they are still in their plastic packaging or have not been unsealed. Products must be returned through our Online Returns Center. This return policy does not apply to digital content or computer software that is not provided on a physical medium (eg on a CD or DVD). Return costs are reimbursed for returns of clothing or shoes purchased on Designyours.fr stores and covered by the free return policy for fashion items.
If you return a product(s) in accordance with our return policy, we will refund the price you paid but not the delivery costs of your original purchase. Similarly, the risks associated with transport and the return delivery costs will be your responsibility. Delivery and return costs are only reimbursed for clothing and shoes purchased on one of our sites. This returns policy does not affect your legal rights, including your statutory right of withdrawal described above.

4. PRICE AND AVAILABILITY
All prices are inclusive of all French taxes (French VAT and other applicable taxes) unless otherwise indicated.
We display the availability of the products we sell on the Website on each product sheet. We cannot provide more details regarding the availability of products than what is indicated on the said page or elsewhere on the Website. When processing your order, we will notify you as soon as possible by email using the address associated with your subscription or via the Communication Manager in Your account, if any products you have ordered become unavailable, and we will not charge you for these products.

1-Click ordering is the fastest and easiest way to order products securely on the site. If you are using a public or shared computer, we strongly recommend that you disable 1-Click Ordering when you are away from the computer.
7. OUR RESPONSIBILITY - GUARANTEES
You benefit from the legal guarantee of conformity under the conditions of articles L.217-4 and following of the consumer code and the guarantee against hidden defects under the conditions provided for in articles 1641 and following of the civil code. You have a period of two years from the delivery of the product to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, you are only required to establish the existence of the lack of conformity and not the date of its appearance.
When the contract for the sale of the product provides for the supply of digital content or a digital service continuously for a period of more than two years, the legal guarantee is applicable to this digital content or this digital service throughout the expected supply period. During this period, you are only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date of its appearance. For these goods, the legal guarantee of conformity entails the professional's obligation to provide all the updates necessary to maintain the conformity of the goods.
You have the right to choose between repairing or replacing the product within thirty days of your request, free of charge and without major inconvenience to you.
Any product repaired under the legal guarantee of conformity benefits from an extension of this guarantee of six (6) months.
If you request the repair of the good, but its replacement has imposed on you, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the product.
You can obtain a reduction in the purchase price by keeping the product or terminate the contract by obtaining a full refund against return of the product, if:
(i) The Professional Seller refuses to repair or replace the Product;
(ii) The repair or replacement of the product occurs after a period of thirty days;
(iii) The repair or replacement of the product causes a major inconvenience for you, in particular if you definitively bear the costs of taking back or removing the non-compliant product, or if you bear the costs of installing the repaired or replacement product ;
(iv) The non-conformity of the product persists despite the seller's unsuccessful attempt to bring it into conformity.
You are also entitled to a reduction in the price of the product or to the resolution of the contract when the lack of conformity is so serious that it justifies the reduction of the price or the resolution of the contract being immediate. You are then not required to request the repair or replacement of the product beforehand.
You are not entitled to rescind the sale if the lack of conformity is minor.
Any period of immobilization of the product for repair or replacement suspends the warranty which remained to run until the delivery of the repaired product.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
The seller who obstructs the implementation of the legal guarantee of conformity in bad faith incurs a civil fine of a maximum amount of 300,000 euros, which may be increased up to 10% of the average annual turnover ( article L. 241-5 of the consumer code).
You also benefit from the legal guarantee against hidden defects pursuant to articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty gives the right to a price reduction if the product is kept or to a full refund against return of the product.
The legal guarantee of conformity applies independently of any commercial guarantee granted.
We are committed to providing all the care customary in the profession for the implementation of the service offered to the client. Nevertheless, our responsibility cannot be retained in the event of delay or breach of our contractual obligations if the delay or breach is due to a cause beyond our control: fortuitous event or case of force majeure as defined by the applicable law. .
Our responsibility will not be engaged in case of delay due to a shortage of stock at the publisher or at the supplier. Some of these updates may not be necessary to ensure product compliance. By agreeing to the Terms of Sale, you agree to receive such updates.
• You agree that updates may be performed automatically, without any action required on your part. An update that is not automatic does not take effect until you install it. You acknowledge that if updates are not installed on time, or if they are not installed correctly, it may adversely affect the performance or functionality of the affected products. Designyours.fr will not be liable for any non-compliance resulting from your failure to properly install updates.
9. APPLICABLE LAW
These Terms of Use are governed by Luxembourg law (with the exception of its conflict of law provisions), and the application of the Vienna Convention on Contracts for the International Sale of Goods is expressly excluded. You, like us, agree to submit all disputes arising from the commercial relationship between you and us to the non-exclusive jurisdiction of the courts of the city of Luxembourg, which means that for the application of these General Conditions of Sale, you can bring an action to assert your consumer rights, in Luxembourg or in the country of the European Union in which you reside.
